Hire Terms & Conditions
Duration
Equipment hire is deemed to start when the item is issued from Milford Beach Activity Centre (MBAC) and ends when the equipment is returned. This includes the safety briefing period.
This Agreement
It is agreed that the Customer will hire equipment from MBAC based on the below terms and conditions. Digital signatures via online bookings are considered binding. By hiring equipment from MBAC you agree to be bound by the below terms and conditions.
Equipment
MBAC will provide equipment that is of merchantable quality and fit for purpose. Equipment should only be used for the purpose for which it was designed and as per the safety briefing. The Customer will comply with all of the manufacturer’s requirements & recommendations respecting the equipment and any applicable laws.
Suitability & Safety
MBAC is not responsible for the use of the equipment. We only provide equipment to be used under the skills and abilities of the hirer, we require no proof of ability and offer only safety advice on the use of the equipment, and how they are to be used as per the manufacturers requirements. Information on the safe area of operation as agreed with Milford Haven Port Authority and as per the company risk assessment for shoreline activities is part of the Safety Briefing prior to use of equipment. MBAC are not liable for any advice given on the use of equipment.
The hirer acknowledges that adventure activities have inherent risks of injury to persons and property and is aware and understands the risks involved. MBAC requires all hirers of SUPs and kayaks to wear buoyancy aids at all times while on the water. The hirer understands the dangers of paddling in waves, tidal, flowing or still water and understands that weather can play a factor in paddling safety and that such activities are subject to the unpredictable forces of nature.
Users of the water craft should be suitably confident in the water and ideally able to swim at least 25m unaided. Users taking dogs on the water craft must use the additional safety equipment and be confident that the dog is able to remain still.
Loss & Damage
The customer is liable for the repair or replacement cost of the hired equipment if damage, theft or loss occurs while the equipment is in their care. Where possible MBAC will provide replacement equipment for the remainder of the hire period but in all cases the customer is liable for the full hire price quoted. Equipment not returned within 24 hours of the agreement end time will be considered lost/stolen.
MBAC are not liable for damage to customer property. Dry bags and phone cases should be suitably checked by the customer prior to use.
Access & Egress Utilising the Slipway
MBAC staff are happy to assist the customer in transporting the equipment to and from the waters edge where required but cannot assist in the launch of water craft for hirers.
Return of Equipment
You are responsible for returning the equipment to MBAC. Any costs, risks and expenses or incidents relating to return delivery are the responsibility of the Customer. Unless otherwise specified, equipment must be returned to a member of MBAC staff. MBAC reserves the right to charge for late returns at an hourly rate of £15 per hour.
Insurance
No insurance coverage for the equipment is required under this Agreement, however MBAC has Public Liability Insurance in place.
Cancellation or Amendments to Bookings
If MBAC cancel a booking we will refund you in full. If you cancel, then a refund will be given only when MBAC is provided with at least 48 hours notice.
On occasions MBAC staff might advise using a different craft such as a Kayak instead of a Stand-Up Paddle Board due to the sea state conditions to ensure the hirers have the easiest craft to manage. No water craft will be hired out in a sea state of 3 or above.
We will not hire to:
- Any parties under the influence of Alcohol or other substances.
- Children under 8 years old.
- Young people under 18 without a parent/responsible adult either in the water or on the shore.
- Anyone 18+ without I.D.
